This agreement is governed by the laws of New Zealand. You irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.
These Terms and Conditions and the Subject Release Form govern the Wellington Regional Stadium Trust’s (“the Stadium Trust”) 10th Anniversary Photo Competition (“the Competition”) and together shall be referred to as the “Competition Terms and Conditions”. Submission of an entry into the Competition shall be taken as your acceptance of the Competition Terms and Conditions. If you do not agree to all of the Competition Terms and Conditions, you should not submit an entry into the Competition.
Entry into the Competition begins on Thursday 25 March 2010 and ends at midnight on Monday 31 May 2010 (“the Competition Entry Period”). Any entries and photograph(s) submitted after the Competition Entry Period will not be considered.
The Stadium Trust reserves the right to cancel the Competition at any time, in its sole discretion, without reason, notification, liability or obligation.
By entering the Competition, you agree that the Stadium Trust shall be entitled to use your photograph(s) in accordance with the Terms and Conditions, and for the purposes contained within the Terms and Conditions, during the Competition Entry Period and thereafter for a period of 18 months.
Who May Enter
The Competition is open to all New Zealand residents, however Stadium Trust employees and their families are not eligible to enter.
How to Enter
For your entry to be valid you must submit up to three photographs and accompanying information using the online entry form by midnight on Monday 31 May 2010 in accordance with the entry requirements and the Competition Terms and Conditions.
Your email entry must contain the following:
a. Your name (please note that if we use your photographs in relation to the Competition or for any promotional purposes, we will identify you only by your first name),
b. A title and short description for each photograph,
By submitting an entry in the Competition, you agree to be bound by the Competition Terms and Conditions, including all eligibility requirements. You also accept that all decisions of the Stadium Trust are final and binding in all matters. Entries that do not comply with the Competition Terms and Conditions may be rejected in the Stadium Trust’s absolute discretion.
The Stadium Trust can in its absolute discretion refuse to award a prize and/or remove an entry if the entrant or the entry does not comply with the Competition Terms and Conditions.
A maximum of three photographs per entrant is permitted.
Each submitted photograph must be in JPG format, no greater than 8Mb in size. Entries that are larger than 8Mb in size may be rejected.
All entries must meet the entry requirements and be suitable for viewing by people of all ages. All entries will be moderated for suitable content before being loaded for viewing on the Westpac Stadium website’s online gallery.
The Stadium Trust in its sole discretion reserves the right to reject any entry from the Competition. Rejected entries will not be entered into the Competition and will not appear in the online gallery.
By entering the Competition, you are stating and warranting that your photographs are original and were taken by you. This means that:
• The Stadium Trust’s use and/or publication of the photographs will not violate or infringe the rights of anyone else or breach any laws, and
• You have obtained and can provide all necessary permissions and releases in relation to each photograph you are submitting, and
• Your photograph(s) have not been previously published, including without limitation in any advertisement, book, magazine, postcard, or calendar.
By entering this Competition, you agree that you have the written consent (in accordance with the attached “Subject Release Form”) of any person or people who are clearly identifiable in your photograph(s), and that you can provide such written consent to the Stadium Trust immediately upon our request.
You agree that where reasonably practicable, you have obtained the consent of all persons who are identifiable within your photograph(s) and that those persons understand the Stadium Trust can hold, use and/or publish their image during the Competition Entry Period and thereafter for a period of 18 months.
If you do not have the written consent of those people identifiable in your photograph(s), do not submit such photograph as part of your entry, as we cannot consider your photograph(s) for the Competition.
The Stadium Trust reserves the right to require the signed Subject Release Form from you before considering your entry or allocating any prize. The Subject Release Form must be in the Stadium Trust’s approved format which is available here
The judges’ decision is final and no correspondence will be entered into either during or after the Competition. The Competition Prize is not transferable and can not be substituted for cash or any other prize.
The Competition winner will be notified by email. The winning photograph will be displayed on the Westpac Stadium’s website along with the first name of the photographer and the subject and/or location of the photograph.
If a Competition winner cannot be notified five days after selection, or in the event of non-compliance with any of the requirements and Terms and Conditions, the Prize will be deemed to have been forfeited and a new winner will be selected.
The Competition winner will receive a Prize consisting of a “Stadium Member for the day package”, which shall comprise two entry tickets, two standard Stadium set-menu meals excluding alcoholic beverages, and two guest passes for the Deloitte Club Member Lounges at Westpac Stadium at the All Blacks v South Africa rugby test match on Saturday 17 July 2010 (“the Prize”). The Stadium Trust shall not be responsible for any other costs incurred in relation to the Prize or the redeeming of the Prize, including but not limited to travel or accommodation costs.
Licence and Purposes for Use
By entering the Competition, you allow the Stadium Trust to use your name and to hold, use, publish, exhibit and/or reproduce the photograph(s) submitted without notice to you, without requesting your further consent, and without any compensation or payment whether during the Competition, in connection with the Competition, in connection with the Prize, in the publication of your entry or the winning entry, and/or for any other promotional purpose, including but not limited to any print or digital promotion during the 18 month period, which shall be in the Stadium Trust’s sole discretion but in accordance with the Competition Terms and Conditions.
All entries submitted in relation to the Competition shall become the property of the Stadium Trust. Copyright in any photograph(s) submitted in relation to the Competition shall remain with you, but in consideration of the Stadium Trust providing the Competition, you grant the Stadium Trust an exclusive, perpetual, worldwide and irrevocable licence to hold, use and publish the photograph(s) in any publication, website and/or for any promotional purposes, in print and/or digital formats during the Competition Entry Period and for an 18 month period after the Competition Entry Period.
Photograph(s) may be kept on file in the Stadium Trust’s image library and may be considered for such purposes at any time during the 18 month period. No payment will be made for the use of any photograph(s) during the Competition Entry Period or during the subsequent 18 month period, and you agree that the Stadium Trust is not required to contact you in relation to any use or publishing of your photograph(s) during this time.
Limitation of Liability
You agree that taking part in this Competition is done so entirely at your own risk and you accept sole responsibility and liability for any damage or loss to yourself, and any other competitor or third party, including but not limited to in relation to intellectual or personal property.
The Stadium Trust will not be responsible for any lost, late, incomplete, illegible, damaged or misdirected entries.
In the event the Competition is compromised in any way, the Stadium Trust reserves the right to cancel the Competition and to determine the winners from all eligible entries by the termination date.
The Stadium Trust will use its best endeavours to comply with its obligations and to maintain any person’s privacy. If a photograph caption is given, the photographer and person(s) within the photograph will only be identified by their first names and likenesses only.
